1. General
1.1. These Terms of Use (“Terms”) govern the relationship between KHOOD FINTECH FZCO (“Company”, “KHOOD”, “we”) and any individual using the khood.capital platform (“User”, “Trader”, “you”).
1.2. By registering, you confirm that you have read, understood, and accept these Terms, the Privacy Policy, and the Refund Policy.
1.3. KHOOD provides a technology platform for the evaluation of trading skills (challenges) and the subsequent allocation of capital to successful traders on a profit-sharing basis. KHOOD is not a broker and does not provide investment advice.
2. Eligibility
2.1. Users must be at least 18 years old (or the age of majority in their jurisdiction).
2.2. The services are not available to persons in jurisdictions where the Company’s activity is prohibited or restricted, or to persons subject to sanctions.
2.3. One User — one account. Creating multiple accounts is prohibited.
3. Evaluation Programs (Challenges)
3.1. A challenge is a paid evaluation of trading skills on a demo account with predefined parameters (profit target, daily and overall drawdown limits, minimum number of trading days).
3.2. The parameters of each plan are published on the platform and become part of these Terms at the time of purchase.
3.3. Passing all phases entitles the Trader to a funded account; breaching the limits results in failure (disqualification) of that challenge.
3.4. Trading is conducted on the trading platforms provided by KHOOD. The primary instrument is XAUUSD (gold), along with other available instruments.
3.5. The Platform may offer additional paid challenge options (for example, a retake). The scope and pricing of options are published on the platform. Option fees are non-refundable regardless of whether the option was used; the non-refundability condition is displayed before the option is paid for.
4. Funded Accounts and Profit Sharing
4.1. A funded account is provided on a profit-sharing basis between the Trader and the Company. The applicable profit split and payout conditions are specified on the plan page and in the Challenge Rules.
4.2. Payouts are made after KYC verification and subject to compliance with the platform rules.
4.3. The frequency and conditions of payouts, including the conditions of the first payout, are published in the Challenge Rules and on the plan page.
4.4. The fee for a passed challenge is refunded to the Trader as part of the first profit payout, in the manner established by the Refund Policy.
5. Prohibited Practices
5.1. The following are prohibited: latency arbitrage, quote manipulation, high-frequency trading (HFT) circumventing the rules, copying trades between accounts without permission, use of insider information, collusion, and exploitation of technical errors.
5.2. The full list and consequences are set out in the separate Anti-Cheating & Prohibited Activities Policy, which forms part of these Terms.
5.3. Violations may result in disqualification, cancellation of results, and/or account closure without a refund.
6. KYC and AML
6.1. Before payouts, the User must complete identity verification (KYC) and, where necessary, confirm their address and source of funds.
6.2. The Company may suspend or refuse service where fraud or a breach of law is suspected.
7. Payments
7.1. Challenge fees and fees for additional options are paid using the payment methods available on the platform.
7.2. Prices are stated in US dollars (USD). Refunds are governed by the Refund Policy.
8. Liability
8.1. Trading involves a high level of risk. The Company does not guarantee profit and is not liable for the User’s trading decisions.
8.2. The platform is provided “as is”; the Company takes reasonable measures to ensure availability but does not guarantee the absence of disruptions caused by third parties (broker, liquidity provider, payment systems).
8.3. The Company’s aggregate liability is limited to the amount actually paid by the User for the relevant challenge.
9. Account Closure
9.1. The Company may suspend or close an account for a breach of these Terms, applicable law, or the platform rules.
9.2. The User may close their account at any time; this does not create a right to a refund outside the scope of the Refund Policy.
10. Amendments and Governing Law
10.1. The Company may amend these Terms by publishing an updated version on the platform.
10.2. These Terms are governed by the laws of the UAE and the rules of the IFZA Free Zone. Disputes are resolved by the competent authorities of the UAE.
